Probate is the process by which a decedent’s estate is administered. Middleton & Middleton represents executors, administrators, and beneficiaries in all areas of estate administration. The probate process applies whether a person dies with a Will or without a Will. In either circumstance, the process involves collecting all of the person’s property, paying all debts and expenses, and distributing the property either according to their Will or according to Texas law regarding intestate distribution (dying without a Will).

Whether one should probate a loved one’s Will, and the type of administration one should initiate, is a question we are asked on a routine basis. Choosing the proper type of administration can mean the difference between an efficient and cost-effective administration or a burdensome and costly administration.
If your loved one died without a Will, there still exists the need for administration of his or her Estate. As mentioned above, Texas law directs how his or her property will be distributed according to the rules of intestate distribution under the Texas Estates Code.
